Lawsuit filed in hopes of halting Legacy Ridge

GOSHEN — A lawsuit filed in state Supreme Court seeks to derail the current version of the proposed Legacy Ridge housing development in the Village of Woodbury.

The plaintiffs are a quartet of Cornwall-based public and private entities: the school board, the Town Board, the Village of Cornwall-on-Hudson's board and the Black Rock Fish & Game Club, a private conservation group.

They're suing the Village of Woodbury and its board, the developers of Legacy Ridge and the owners of the property where the development would be built.

Legacy Ridge would put 287 four-bedroom homes on a 749-acre site in the vicinity of Route 32 and Mineral Springs and Trout Brook roads. The homes would be clustered and more than 400 acres would remain green.

That area of Woodbury is in the Cornwall School District.

Cornwall school officials dispute the developers' claim that Legacy Ridge would produce less than one public school-age child per unit.

The district fears the actual impact on its already-crowded schools will be much larger.

But while it was damage to the school district that first prompted the suit, the plaintiffs also claim the project will pollute Woodbury Creek and Moodna Creek, into which the Woodbury flows. Both are popular sites for fishing and other recreational pursuits.

The plaintiffs are asking a state Supreme Court justice to overturn two Woodbury village local laws adopted earlier this year that changed the zoning to allow 287 units. Previous zoning allowed only 155 units.

The suit charges the changes amounted to "illegal spot zoning" to benefit one developer.

They're also asking the judge to overturn the project's final environmental impact statement and the findings statement that supported it.

They claim state environmental law procedures, as well as state general municipal law and even the Village of Woodbury's own codes, were not followed in assessing the plan.

Gerald Jacobowitz, the lawyer for Legacy Ridge, said he couldn't comment because his client has not been served with a copy of the lawsuit yet.

Richard Golden, the lawyer for the Village of Woodbury, was on vacation and couldn't be reached, and a message left for village Mayor Stephanie Berean-Weeks was not returned.



And let us not forget Ralph's front man, Anthony No-Taxation-Without-Representation Incanno, who isn't even registered to vote.

The facts are this: Read the paper new home sales are down 35% in orange county. These homes will never sell and the only group growing is KJ. So you put 2 + 2 and you get sell the land to them. Why would any smart person keep the land? Thanks Ralph , Don and Bob.

How do you put KJ into this. The land is separated from their village by quite a number of miles so annexation is out of the question. They can't make another village out of it. AND (unless the village idiots decide to change the zoning for a developer again) they can't build like they do at KJ. I advise all of you to get off your paranoia horse and get on with your lives.

It is absolutely amazing that people repeat something that isn't true. Yes, even with a village of woodbury, KJ can still annex! The "separated by miles" means nothing if the "miles" are not owned by the town or village. And the formation of a village inside Woodbury was never a threat, unless Timber Ridge was thinking of forming their own village. Why not ask Bob D. on that one? Oh wait, he left town...
Did HE sell to KJ?

The "change for a developer" was not for the developer, it was to get lots of good things like land owned by the Village, which cannot be annexed. and if you don't think that is an issue, then tell those morons in Cornwall to start looking at who owns land in their town. So, the "Village Idiots" as you call them, are doing the very thing that you want, Protecting Woodbury, and that is also the very thing that you are attacking them for. What's wrong with that picture?

If the project doesn't go through, does that mean that they can annex land from Woodbury into the town of Cornwall????
I live in skyline and dont want that to happen. Besides that project may not be a bad thing. I hear that we (Skyline) will have our sewers fixed if the project goes through.

I doubt that Cornwall has any interest in annexing parts of Woodbury (but they do so many strange things there that you never know).

Do yor homework, KJ is looking for water and they own alot of land from trout brook road all the way up to the old Star plant.

Is it true that Wayne Corts has sold the trailer park to KJ? What is going to happen to the people who there?

Star of Mountainville owned large tracts of land on both sides of Rt 32.

Ziggy Brach bought the land and buildings on the west side of 32 and uses them as warehouses.

The land on the east side has a great deal of water. It was offered to the Town of Cornwall when Richard Randazzo was supervisor. He said that he was interested, but never did anything about it.

Eventually the owners sold it to the same people who control most of the land in Kiryas Joel.

Point taken. Not signing your name just means you wish to remain anonymous; it doesn't prove or disprove anything. Oh, and someone better tell Ralph that he is moving to Florida. He doesn't know about it yet.

As far as the trailer park, it seems like good ol' Wayne did it to us again: selling land to the KJ folk. But that doesn't mean that everyone there should run out into the streets screaming. KJ folk are not going to move into a trailer park but they are going to collect the rents.And they have to honor current leases until they run out. It's business.

And they can't form a village inside a village.

Mike proved to be one huge embarrassment to Ralph Caruso, the Parks Dept, the Town Bd and ultimately himself. Always alot of talk and very little action... except his grandstanding over the Walmart sign and his last minute speech about those who stole the election. Always liked to put that proverbial knife in Conroy's back...Ralph's little gopher never really knew which side of the fence to stand on until he discovered which was the most popular. Like Bo, he would abstain from important votes rather than stand up like a man and vote Yes or No. Truthfully, like Dobson, we're a hell of alot better off with him out of town. Perhaps he could convince his mentor,Caruso to join him???
